#1. Agreement
These Terms of Use ("Terms") form a binding agreement between you and BX Team ("we", "us", "our") and govern your use of our website, the BX ID authentication system, the Pulsify observability platform and dashboard, and any related services (collectively, the "Services").
By creating an account, installing the Pulsify SDK, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
BX Team is an informal open-source community, not a registered legal entity. References to "we" refer to the contributors who maintain the Services collectively.
#2. Eligibility and accounts
#2.1 Age requirement
You must be at least 16 years old if you reside in the European Economic Area or the United Kingdom, or 13 years old in all other jurisdictions. By using the Services, you represent that you meet the applicable minimum age. We do not perform active age verification; this is your responsibility (or the responsibility of your parent or legal guardian).
#2.2 Account registration
You may create a BX ID account using Discord OAuth, GitHub OAuth, or email magic link. You agree to:
- Provide accurate information
- Keep your account credentials and access to your linked email/OAuth providers secure
- Be responsible for all activity that occurs under your account
- Notify us at [email protected] if you suspect unauthorized access
We may suspend or terminate accounts that violate these Terms, are inactive for an extended period, or create risk for the Services or other users.
#2.3 One person per account
Each account is intended for a single individual or a single legal entity (in the case of an organization). You may not share account credentials.
#3. Use of the Services
#3.1 Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law
- Send data through the Pulsify SDK that you do not have the right to collect or transmit
- Submit personal data of third parties through the dashboard, custom metrics, or error context without a lawful basis
- Attempt to gain unauthorized access to the Services, other accounts, or our infrastructure
- Probe, scan, or test the vulnerability of the Services without our written permission
- Interfere with, disrupt, or place excessive load on the Services (including by sending excessive telemetry events)
- Reverse engineer, decompile, or extract source code from server-side components (the Pulsify SDK is open source and exempt from this restriction)
- Use the Services to develop or train competing products without our written permission
- Misrepresent your identity or impersonate any person or organization
- Upload or transmit malware, viruses, or any code intended to harm the Services or its users
- Resell, sublicense, or commercially redistribute access to the Services
#3.2 Rate limits and fair use
The Services are currently provided free of charge with reasonable usage limits. We reserve the right to introduce, modify, or enforce rate limits, quotas, or fair-use policies at any time. We will provide reasonable notice of material changes where practical.
If your usage materially exceeds typical patterns and creates undue burden on the Services, we may throttle, limit, or suspend your access.
#4. Pulsify SDK and telemetry
#4.1 Server operator responsibilities
If you install the Pulsify SDK on a Minecraft server, you act as a data controller for the data the SDK collects from your server (under GDPR Article 4(7)). You agree to:
- Inform players on your server that telemetry is collected and provide them with a privacy notice that meets applicable legal requirements
- Establish a lawful basis for processing under GDPR Article 6 (typically legitimate interest or consent, depending on your context)
- Honor data subject requests from your players, including deletion requests
- Not transmit data through the SDK that you are not legally permitted to collect
We act as a data processor for telemetry and process it only according to your configuration and these Terms.
#4.2 Data you submit
You retain ownership of the data you submit to the Services through the SDK or dashboard. You grant us a limited, non-exclusive license to host, process, transmit, display, and back up that data solely for the purpose of operating the Services for you.
We may produce aggregated, fully anonymized statistics (containing no information that could identify you, your server, or your players) for product improvement, public reporting, or research. Such aggregated data is not considered your data.
#4.3 SDK license
The Pulsify SDK is distributed as open-source software under its accompanying license. You are free to inspect, modify, and self-host it. If you fork or modify the SDK and direct it away from our servers, the resulting telemetry stream is no longer governed by these Terms or our Privacy Policy.
#5. Intellectual property
#5.1 Our property
We and our contributors own all rights, title, and interest in and to the Services, except for:
- Your data (Section 4.2)
- Open-source components, which are governed by their respective licenses
- Third-party trademarks (Minecraft, Mojang, Microsoft, Discord, GitHub, etc.)
The "BX Team", "BX ID", and "Pulsify" names and logos are the property of BX Team contributors. You may not use them in a way that suggests endorsement or affiliation without our permission.
#5.2 Open-source components
Many parts of our software stack are open source. Those components are licensed under their respective licenses (typically MIT, Apache 2.0, or similar) and are not restricted by these Terms beyond what those licenses permit.
#5.3 Minecraft
Minecraft is a trademark of Mojang Synergies AB / Microsoft Corporation. We are not affiliated with, endorsed by, or sponsored by Mojang or Microsoft.
#6. Service availability
The Services are provided on an "as available" basis. We do not guarantee uptime, availability, or that the Services will be free of errors, bugs, or interruptions. We may, at any time and without prior notice:
- Modify, suspend, or discontinue any part of the Services
- Perform maintenance that may make the Services temporarily unavailable
- Refuse service to any user
We will make reasonable efforts to provide advance notice of significant changes via the website or email.
#7. Termination
#7.1 By you
You may stop using the Services at any time. You may delete your account and all associated projects from the dashboard. Account deletion removes your personal data per our Privacy Policy and Section 6 (Data retention) thereof.
#7.2 By us
We may suspend or terminate your access to the Services, with or without notice, if:
- You violate these Terms
- We are required to do so by law
- Continued provision of the Services to you creates legal, security, or operational risk
- We discontinue the Services entirely
Upon termination, sections that by their nature should survive (Sections 4.2, 5, 8, 9, 10, 11, 12) will survive.
#8. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR TRADE USAGE.
We do not warrant that:
- The Services will meet your requirements
- The Services will be uninterrupted, timely, secure, or error-free
- Telemetry data will be retained without loss
- Any defects will be corrected
You use the Services at your own risk.
#9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BX TEAM, ITS CONTRIBUTORS, OR MAINTAINERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, arising out of or relating to your use of the Services, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
Because the Services are provided free of charge, our aggregate liability to you for any and all claims relating to the Services shall not exceed fifty euros (€50).
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (such as liability for gross negligence, willful misconduct, or, where applicable, statutory consumer rights).
#10. Indemnification
You agree to defend, indemnify, and hold harmless BX Team and its contributors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any law or third-party rights, including the privacy rights of players on a server using Pulsify under your control
- Data you submit through the Services
#11. Changes to these Terms
We may update these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Material changes will be announced on the website and, where appropriate, by email. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.
#12. Governing law and disputes
Because BX Team is an informal community without a registered jurisdiction, the parties agree as follows:
- These Terms shall be interpreted in good faith.
- For users in the European Economic Area, the United Kingdom, or other jurisdictions with mandatory consumer protection laws, those laws apply where they would otherwise be diminished by these Terms.
- Disputes should first be raised informally with us at [email protected]. We will make a good-faith effort to resolve disputes through direct communication before any formal proceedings.
- Where a competent court must adjudicate a dispute, the parties consent to a court of competent jurisdiction in the place of the user's habitual residence (for consumers) or in any forum where jurisdiction may properly be established (for non-consumers).
#13. Miscellaneous
- Severability — If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.
- No waiver — Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Entire agreement — These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Services.
- Assignment — You may not assign your rights under these Terms without our consent. We may assign our rights and obligations to a successor entity (for example, if BX Team formally incorporates).
- No agency — Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.
